Discover Fort Smith Photo, Video & Content Usage Policy
Our Content
Discover Fort Smith creates and commissions photography, video, graphics, written content, and other creative assets to promote Fort Smith as a destination (“Discover Fort Smith Content”).
Our destination marketing efforts are funded through the City of Fort Smith's lodging tax and governed by Arkansas Code § 26-75-606, which states that money must be used to advertise and promote the city and local area. These assets represent an investment in promoting our community and supporting Fort Smith's visitor economy.
Unless otherwise noted, Discover Fort Smith Content is owned by Discover Fort Smith or used under applicable licensing agreements. Access to Discover Fort Smith Content does not automatically grant a viewer of such content permission to use it.
Using Our Content
Any permission granted by Discover Fort Smith to use Discover Fort Smith Content applies only to the use specifically approved. Unless we specifically authorize it, Discover Fort Smith Content may not be:
- Sold, sublicensed, or redistributed to others;
- Used for merchandise, resale, paid advertising, or other commercial purposes;
- Significantly altered or used in a misleading or inappropriate way;
- Added to another organization's permanent photo, video, or stock asset library;
- Used to train artificial intelligence or generative AI systems; or
- Used in a way that suggests Discover Fort Smith endorses a product, business, organization, political position, political candidate, or cause.
With respect to any permission given to utilize Discover Fort Smith Content, we may require the credit "Courtesy of Discover Fort Smith" or additional creator attribution when appropriate.
People & Model Releases
Discover Fort Smith Content may include identifiable people, including minors. Model releases obtained by Discover Fort Smith or its contractors are intended only for use in connection with Discover Fort Smith and its mission. Some people appearing incidentally in public settings may not have signed a release.
Permission to use Discover Fort Smith Content does not transfer or extend any model release or other rights related to a person's likeness. Because of this, some Discover Fort Smith Content may not be available for outside use or may have additional restrictions.
Sharing on Social Media
You're welcome to use the built-in sharing features on social media to share Discover Fort Smith Content while keeping the original account, credit, and context intact.
Downloading our content and reposting it separately requires permission.
